The meeting was started by
Gary DeJarnatt at approximately 9:30 am. And the minutes from the March 20th
meeting in Yamhill County were accepted as written.
Chuck P. discussed whether
to update the county surveyor questionnaire, it will be e-mailed out soon, to
be updated for the spring conference.
Chuck G. questioned if a
“plat vacation” included a partition plat. Discussed situation specific
information and other general information.
Discussion of R/W dedication
in a replat.
Gary D. asked a question
about lot consolidation verses plat vacation (to remove lot line) much
discussion, no resolution.
Round table discussion about
PLA’s and how each county handles them.
Chuck G. gave presentation
on unrecorded surveys where monuments were set, but survey was not filed.
Answer is to fill out a complaint form from OSBEELS and send a copy to the
surveyor, telling them to comply or be turned into the Board.
The particular survey
presented was by a surveyor licensed in Washington and now Oregon. Washington
would revoke his license as well if Oregon revokes.
Gary D. gave presentation on
a R/W discrepancy between state highway and old plat. Which one holds? The
answer is, whatever was shown on the descriptions should hold. The plat held
the Section line and the road centerline once followed the section line. The
current State Road Survey shows a different centerline that does not appear to
follow the original Section line. The state survey may be in error.
PLCP ORS 203.148 fee was
discussed. Several counties need to see increase to maintain current services.
Gary D. made motion to review fee for possible increase and presentation to
PLSO for discussion and future legislature changes. Bob 2nd.
General discussion about
Crook Co. v Shotgun creek road legalization case. See handout.
Mike B. presented a large
survey problem, many ideas were discussed to resolve matter, general consensus
was that it will have to be resolved by the courts.
Chuck G. presented a handout
for spring conference. Some additional potpourri items were discussed including
ORS ch 368 and plat title reports.
Carl discussed condominium
plat issue.
